Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and PD World (“we,” “us,” or “our”) governing your access to and use of the pd-world.com platform and all related services (collectively, the “Platform”).

01Acceptance of Terms

By creating an account, accessing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

• You must be of legal age in your jurisdiction to create an account. PD World is designed for professional use.
• If you do not agree to these Terms, you must discontinue use of the Platform immediately.
• Continued use of the Platform after changes to these Terms constitutes acceptance of the updated Terms.

03Account Responsibilities

3.1 Account Creation

• You must provide accurate, current, and complete information during registration.
• You may only create one account per person or organization unless expressly authorized.
• You are responsible for maintaining the confidentiality of your login credentials.

3.2 Account Security

• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized access or security breach via our contact page.
• We reserve the right to suspend accounts that show signs of unauthorized access to protect you and other users.

3.3 Trainer Representations

Trainers must accurately represent their qualifications, certifications, experience, and professional background. Misrepresentation of credentials may result in immediate account suspension and removal from the Platform.

04Platform Usage

PD World provides a suite of tools designed to support the professional development ecosystem:

4.1 For Trainers

• Profile creation and professional portfolio management.
• Storefront setup for marketing services and sharing specialties.
• Engagement management: proposals, scheduling, delivery, and follow-up.
• Content creation tools: course builder, AI-assisted content generation, blog authoring.
• Analytics and insights on profile views, engagement performance, and revenue.

4.2 For Organizations

• Trainer discovery with advanced search, filtering, and bookmarking.
• Engagement lifecycle management: booking, scheduling, evaluations, and reporting.
• Team management and learner enrollment for LMS courses.
• AI-powered evaluation summaries and engagement recaps.

4.3 For Learners

• Access to courses, learning paths, and self-paced educational content.
• Progress tracking, quiz completion, and certification.
• Personalized learning dashboards and achievement tracking.

4.4 Acceptable Use

You agree to use the Platform only for its intended professional development purposes and in compliance with all applicable laws and regulations.

05Trainer–Organization Relationships

• Trainers operate as independent contractors, not employees of PD World or the booking organization.
• Organizations and trainers are solely responsible for the terms of their engagements, including scope, deliverables, timelines, and compensation.
• PD World does not mediate disputes between trainers and organizations, though we may provide tools to facilitate resolution.
• Off-platform transactions that circumvent Platform fees violate these Terms and may result in account suspension.
• Both parties should maintain their own records of engagement agreements and deliverables.

06Content & Intellectual Property

6.1 Your Content

• You retain full ownership of all content you create or upload to the Platform.
• By posting content, you grant PD World a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content solely within the Platform and for marketing purposes.
• You may remove your content at any time — removal terminates the license above, except for cached copies and backups retained per our data retention policy.
• You represent that you have the right to share any content you upload and that it does not infringe on third-party intellectual property rights.

6.2 PD World's Intellectual Property

The Platform, including its design, code, features, branding, logos, and documentation, is the proprietary property of PD World. You may not copy, modify, distribute, sell, or create derivative works from any part of the Platform without prior written consent.

07AI-Generated Content

PD World integrates AI-powered features (powered by Anthropic Claude) to assist with content creation, evaluation summaries, proposals, and other professional tasks.

• You retain full ownership and commercial rights to all AI-generated content created through the Platform.
• AI-generated content is provided as a tool — you are responsible for reviewing, editing, and ensuring accuracy before use.
• PD World does not guarantee the accuracy, completeness, or suitability of AI-generated content for any specific purpose.
• AI content is clearly labeled as AI-assisted within the Platform.
• Your inputs to AI features are processed in real-time and are not retained by our AI providers for model training.

08Fees & Payments

8.1 Platform Fees

PD World offers free and paid tiers. Applicable fees, including subscription pricing and marketplace commissions, are described on our pricing page. We reserve the right to modify pricing with advance notice to affected users.

8.2 Payment Processing

• All payments are processed securely through Stripe. PD World does not store credit card numbers on our servers.
• You agree to provide accurate billing information and authorize charges for services you purchase.
• Marketplace commissions are deducted from engagement payments before trainer payouts.
• Payout schedules and methods are governed by Stripe's terms and your connected account settings.

8.3 Refunds

Refund eligibility depends on the nature of the transaction. Subscription refunds are handled per our cancellation policy. Engagement-related disputes should be resolved directly between the trainer and organization. PD World may facilitate refunds at its discretion for Platform-related issues.

09Subscriptions & Billing

• Subscriptions are billed on a recurring basis (monthly or annually) as selected during purchase.
• You may cancel your subscription at any time through account settings. Cancellation takes effect at the end of the current billing period.
• No partial refunds are issued for unused portions of a billing period.
• Downgrading from a paid plan may result in loss of access to premium features. Your data will be retained and accessible if you re-upgrade.
• We will notify you before any price increases take effect on your subscription.

10Prohibited Conduct

You agree not to engage in any of the following:

• Using the Platform for any illegal purpose or in violation of applicable laws.
• Harassment, discrimination, intimidation, or abusive behavior toward any user.
• Impersonating another person, organization, or misrepresenting your affiliation.
• Uploading malicious code, viruses, or content designed to disrupt Platform operations.
• Scraping, crawling, or automated data extraction from the Platform without written consent.
• Circumventing Platform fees by arranging off-platform payments for connections made through PD World.
• Spamming, bulk messaging, or unsolicited commercial communications through Platform messaging.
• Attempting to gain unauthorized access to other users' accounts or Platform infrastructure.
• Using the Platform to compete with or create a substantially similar service.
• Manipulating reviews, ratings, or engagement metrics.

11Privacy & Data Protection

Your privacy is critically important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We collect only the data necessary to operate and improve the Platform.
• We do not sell your personal data to third parties.
• You have the right to access, export, and delete your data at any time.
• We strive to comply with applicable data protection regulations in the jurisdictions where we operate.

12Disclaimers

• We do not guarantee uninterrupted, error-free, or secure access to the Platform.
• We do not endorse, verify, or guarantee the qualifications, quality, or suitability of any trainer or training service.
• We do not guarantee the accuracy or reliability of AI-generated content.
• We are not responsible for any loss of data resulting from circumstances beyond our reasonable control.
• We do not warrant that the Platform will meet your specific requirements or expectations.

13Limitation of Liability

To the maximum extent permitted by applicable law:

• PD World's total aggregate liability for any claims arising from or related to these Terms or the Platform shall not exceed the total fees paid by you to PD World in the 12 months preceding the claim.
• In no event shall PD World be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, business opportunities, or goodwill.
• This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and whether or not PD World has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

14Indemnification

You agree to indemnify, defend, and hold harmless PD World, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from:

• Your use of or access to the Platform.
• Your violation of these Terms or any applicable law.
• Your content or any content you submit, post, or transmit through the Platform.
• Your infringement of any third-party intellectual property or other rights.
• Any engagement or transaction between you and another user of the Platform.

15Dispute Resolution

15.1 Informal Resolution

Before initiating any formal dispute proceedings, you agree to first contact us at support@pd-world.com and attempt to resolve the dispute informally.

15.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which PD World is incorporated, without regard to conflict of law principles.

15.3 Jurisdiction

Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where PD World is incorporated.

16Termination

16.1 By You

• You may close your account at any time through your account settings.
• Upon account closure, your data will be deleted within a reasonable timeframe, except where retention is required by law.
• Active subscriptions will continue until the end of the current billing period. No partial refunds will be issued.

16.2 By PD World

• We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law.
• For non-urgent violations, we will provide notice and an opportunity to remedy the issue before termination.
• For severe violations (fraud, abuse, security threats), we may suspend your account immediately without prior notice.
• Upon termination, you may request export of your data before it is deleted.

16.3 Effect of Termination

The following sections survive termination: Content & Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.

17Modifications to Terms

We may update these Terms from time to time. When we make material changes:

• We will notify registered users via email before material changes take effect.
• A banner or notice will be displayed on the Platform highlighting the update.
• The "Effective date" and "Last updated" dates at the top of this page will be revised.
• If you disagree with updated Terms, you may close your account before the effective date.

18General Provisions

• Entire Agreement — These Terms, together with the Privacy Policy and any supplemental terms, constitute the entire agreement between you and PD World.
• Severability — If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
• Waiver — Failure to enforce any provision of these Terms does not constitute a waiver of that right.
• Assignment — You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Force Majeure — PD World shall not be liable for any failure to perform due to circumstances beyond its reasonable control, including natural disasters, pandemics, government actions, or internet infrastructure failures.
• No Third-Party Beneficiaries — These Terms do not create any rights for third parties.
